Be it enacted by the Senate of the Commonwealth assembled and the President of the Commonwealth presiding.


Article I

  1. The President of this Commonwealth, acting under the supervision of the Senators of the Senate Pro Tempore outlined herein, shall introduce this Constitution, to be ratified by that Senate only upon unanimous consensus.
  2. Should Senate Pro Tempore fail to pass this Constitution, they shall provide reasoning for which the President of this Commonwealth may correct it.
  3. Should a new Constitution be proposed, this Article shall be retained, with revisions permitted.
  4. Constitutional Amendments carry the same weight as the text of the Constitution, and shall be treated as such. In addition to this, Amendments have the ability to rescind, strike, or supersede any text within the following Articles.
  5. In order to amend this constitution--
    1. A bill must propose an amendment
    2. This amendment must pass with a super majority vote of the Senate
    3. The President may provide remarks, and shall either pass or veto
    4. A further vote of three-fourths of the Senate may be taken to overpower the veto
    5. The people of the Commonwealth must vote in super majority to ratify an amendment.
  6. Should the Commonwealth President choose, independently, they may resign their position and appoint someone to the position of Commonwealth President, after which that individual must be verified by the Senate by vote of Super Majority.
  7. Upon ratification of this Constitution--
    1. The Senators of the Senate Pro Tempore shall be granted a seat on the Senate or Supreme Court in lieu of the typical rules stated in this Constitution.
    2. The position granted therein shall be according to random selection made by the President.
    3. The Senate Pro Tempore is to be dissolved.

Article II

In determining the meaning of any form of law, unless the context indicates otherwise, in no particular order whatsoever, the following may be used--

  1. words importing the singular include and apply to several persons, parties, or things;
  2. words importing the plural include the singular;
  3. words importing any gender includes all other genders as well, unless otherwise stated;
  4. words used in the present tense include the future as well as the present;
  5. the words "person" and "whoever" include partnerships as well as individuals;
  6. "Journal" describes the ledger by which the President of the Commonwealth shall record;
  7. "Senator" describes anyone who is a sitting official in the Senate Chambers;
  8. "Justice" describes anyone who is a sitting official in the Supreme Court;
  9. "Order" describes a method by which the Commonwealth President may make statements as an official;
  10. "signature" includes a mark when the person making the same intended it as such;
  11. "oath" includes affirmation, and "sworn" includes affirmed;
  12. "Commonwealth President" describes the President of the Commonwealth;
  13. "Federal seat" describes the District that houses the Supreme Court, Commonwealth Senate, and the Federal executive;
  14. No section of any law is retroactive unless expressly stated otherwise;
  15. Words and phrases shall be read with their context and shall be construed according to the common and approved usage of the language;
  16. The word "shall" is mandatory and the word "may" is permissive;
  17. When the wording of a law is clear and unambiguous, the letter of it shall not be disregarded under the pretext of pursuing its spirit;
  18. Clerical and typographical errors in the laws shall be disregarded when the meaning of the legislature is clear;
  19. Unless it is otherwise clearly indicated by the context, whenever the term "or" is used in any form of law, it is used in the disjunctive and does not mean "and/or";
  20. The repeal of a repealing law shall not revive the first law;
  21. "Code of the Commonwealth" may describe the law of the people;
  22. "Senate Rules" describes a set of separate rules for the Senate to govern itself by, notwithstanding word of the Code of the Commonwealth;
  23. All times must be provided in either Central Time (being that of Daylight or Standard);
  24. "Super Majority" describes a vote of two-thirds, or greater, yea, limited to the total number of Senators;
  25. "Simple Majority" describes a vote of one-half plus one or greater, yea, limited to the total number of Senators;
  26. "The Commonwealth of Acropolis" describes the constitution’s formed government’s name;
  27. The Enacting Clause is described as "Be it enacted by the Senate of the Commonwealth assembled and President of the Commonwealth presiding."
  28. The Resolving Clause is described as "Resolved by the Senate of the Commonwealth assembled.", and resolutions bearing this clause shall expire one month after passage unless formally renewed by the Senate in agreement with the President.
  29. The Ordering Clause is described as "It is hereby ordered by the power of the Supreme Court of the Commonwealth and the inferior courts ordained thereof."
  30. "Month" describes a standard period of exactly 30 consecutive days.

  4. All individuals residing within this Commonwealth must follow every law in the Code of the Commonwealth unless explicitly stated otherwise.

Article IV

  1. The Commonwealth President has abilities to debate a bill

    1. managing existing executive offices established by law;
    2. filing for holidays;
    3. making generalized statements;
    4. extending break periods for the Senate;
    5. adjourning sine die and per annum;
      1. When adjourning sine die, and both the Senate and Supreme Court comply with the adjournment, the President’s office is to be considered furloughed.
        1. Should the sine die power be abused, it may be classified a high crime
      2. When adjourning per annum, the Senate is to be dissolved for a period of 5 days, in which all Senators are to be relieved of their duties.
    6. other abilities as provided by the Code of the Commonwealth;
  3. The Commonwealth President must follow every law in the Code of the Commonwealth.
  4. Upon passage of a bill into law, the Commonwealth President has 7 days, not including Sundays, to either veto, with reason and amendments back to the Senate, or amend the Code of the Commonwealth to match.
    1. Should the Commonwealth President fail to veto the legislation, or amend the Code of the Commonwealth, the bill is assumed to be enacted into law.
    2. Should the President choose, a bill may be sent to referendum, at which point the time limit expires and rules of referendum become effective.
  5. Upon passage of a resolution into effect, the Commonwealth President and Executive branch has 3 days, not including Sundays, to recognize and follow its rules and regulations
  6. The Commonwealth President, or another appointee, shall join persons in marriage, render name changes, and render changes in gender.
  7. The Commonwealth President may additionally introduce legislation for the Senate to consider, provided it be numbered in sequential increasing order based on year

Article V

  1. The Senate President--
    1. shall not be able to vote unless breaking a tie;
    2. shall certify, along with one other Senator, the Journal at the beginning of each session;
    3. shall provide the Commonwealth President chance to debate a bill;
    4. shall recognize Senators for speaking;
    5. shall direct the Clerk to let the record reflect a general statement or remark;
    6. shall convene and adjourn all meetings according to a schedule with breaks, of which shall not be longer than three days, not including Sundays, holidays, or break periods;
    7. shall adjourn sine die, stating "I, as President of the Senate, in accordance with orders of the President of the Commonwealth, hereby adjourn sine die."
  2. Unless permitted by a Senatorial resolution, an individual may not sit for more than 1 year at a time in the position of Senate President, and may not sit for more than 2 consecutive terms.

Article VI

  1. All charters and treaties are to be adopted by the Senate and President, and require a referendum vote to become effective. All charters and treaties hold full faith and credit of this constitution, and shall be treated as holding more power over the Code of the Commonwealth, yet shall not hold more power than this Constitution.
    1. the referendum should have one option per smallest titled subdivision of the Charter or Treaty to be adopted.
      1. only if all subdivisions individually pass a simple majority shall the referendum pass, regardless of the total majority.
  2. Title 0 of the Code of the Commonwealth--
    1. shall be titled "Treaties and Charters"
    2. shall be reserved only for charters and treaties ratified by the people.
    3. shall be effective in any order, unlike typical laws that are effective constructively in order
      1. an exception is to be granted to charters, of which construct unto other charters in effect, provided the citizens agree via the referendum power presented at such time as is standard to that of ratification of such a charter.
  3. Executive offices--
    1. Shall be formed by Executive Order
    2. Shall have a presiding Senate committee
    3. Shall be chaired by a Secretary--
      1. promoted by the President
      2. confirmed to work by Senate in special hearing convened by the chairperson of the corresponding Senate committee
      3. who completes their work on behalf of the President, Senate, and this Constitution
    4. Shall only work within definitions provided by the Senate or President in the form of law, resolution, or order.
  4. All powers vested in the Commonwealth President or the Senate President may be exercised by anyone residing in the respective branch provided express permission is provided.

Article VII

  1. The Supreme Court of the Commonwealth shall have all judicial power vested in it.
  2. In the event the Senate ordains and establishes inferior courts, they too shall have judicial power not exceeding that of the Supreme Court.
  3. The judicial power shall extend to all cases, in law and equity, arising under this constitution, the laws of the Commonwealth, and treaties and charters made.
  4. The judicial power shall be enforced by Judicial Orders, which may nullify Laws, Executive Orders, prior Court Orders, and Resolutions.
  5. Judicial power shall only be vested at times where a ruling is made that a law or order is deemed unconstitutional, or that persons violated laws.
  6. Judicial Orders shall also be used to serve bench warrants to order someone’s presence in front of a court and jury of his peers.
  7. Should the Senate adjourn sine die, the Supreme Court shall either strike down or follow suit with such.
    1. Should the adjournment be struck, and the Senate previously adjourned, the Senate must convene.
    2. Should the order be followed, and the Senate adjourn, all proceedings shall be postponed until further notice and the Supreme Court adjourn until further notice.
      1. Such notice as provided when the adjournment sine die order is struck.

Article VIII

  1. When a government year is determined to be finished, an extra 5 days shall be used by the government to elect new senators, justices, executive officers, and other important positions.
  2. These 5 days account for the difference between a government year and a calendar year.
  3. On the first day of the 5 day period, the president shall introduce a per annum adjournment executive order stating the year to be over, dismissing the Senate and its president, along with granting the Senate the ability to start an election, as well as sealing the Journal and restarting the bill series.
    1. This election shall be finished by the termination of this period.
  4. Election results should be counted such that the people alone select their representatives.
  5. At least 8 Senators may be selected, yet there is no limit on the number of Senators that may run.
    1. These 8 Senators shall be voted upon by the entire Commonwealth.
    2. 4 additional Senators are granted per District and Territory, not including the Federal seat and its first Territory or District.
  6. At least 4 Justices may be selected, yet there is no limit on the number of Justices that may run.
    1. These 4 Justices shall be voted upon by the entire Commonwealth.
    2. 2 additional Justices are granted per District and Territory, not including the Federal seat and its first Territory or District.
  7. All additional seats granted in accordance with the above--
    1. are considered optional;
    2. must be filled and voted upon by the people of the District and Territories granted those seats.
  8. Additional seats not granted per District or Territory--
    1. may be granted by the Commonwealth President;
    2. shall not be removed unless approved by the Supreme Court;
      1. any removed seat shall not be made null until the remaining time of that government year elapses.
    3. seats granted may be filled and voted upon by anyone regardless of District or Territory.
  9. There is no requirement to be a Senator or Justice, other than to have citizenship in the Commonwealth.
  10. On the last of the 5 days, the president shall certify the Senate and Supreme Court voting results, thus granting the Senate and Supreme Court the ability to convene.
    1. Additionally, the Senate and Supreme Court shall convene to establish the leadership of the Senate, including President, Clerk, Aide to the President, Sergeant-at-Arms, and the Chief, as well as ensuring the Senate Committees are governed, and also writing rules for the Senate and committees therein.
    2. The Clerk shall handle publications in the branch’s respective section of the Journal.
    3. The Aide to the President shall handle relations and communications from the public to the Senate President.
    4. The Chief shall communicate with the Commonwealth President concerning Senate actions, such as laws passed by the Senate.
  11. The day after the first day, the Senate Committees shall meet to adopt or amend rules.
  12. Additionally, the Commonwealth President shall adopt their own cabinet by vote of the people.
    1. In the event no people are available to act as cabinet members, or there be not positions for cabinet, this vote shall be waived.
  13. The cabinet shall consist of the Secretaries of the Departments and a Clerk.
    1. The Clerk shall work as directed by the President.
    2. Should no persons be available to act as Clerk, the President may assume the role.
  14. When an adjournment sine die of the Senate and Supreme Court occurs, the government year is to stop as it were, and shall not progress until it is reconvened.
  15. It shall be a right and responsibility of the people to enjoy suffrage within this Commonwealth, their District, and their Territory therein.

Article IX

  1. The Commonwealth recognizes it has a responsibility to keep its people safe. In that line of thinking, the following are hereby abolished, and shall never gain effect:
    1. Taxes, unless dealing with fines of the law;
    2. Minting of currency;
    3. Capital punishment;
    4. A militia of any kind;
  2. However, it should also be known that it is the responsibility of the Supreme Court, and any ordained inferior courts, to punish the people of the Commonwealth due to a violation of a crime.
  3. Additionally, to further the advancement of the Commonwealth’s ideals, the United States Bill of Rights of 1789 shall be adopted, with certain edits permitted at the direction of the Senate, as a Charter, no later than one Government Year after this Constitution is ratified, under the Title 0 Chapter titled "The Bill of Rights of 1789".
  4. It shall be the duty of the Commonwealth to ensure transparent and free access to the Journal by the people of the Commonwealth not be infringed upon.
  5. It shall be the duty of the Commonwealth to explain any Constitutional amendments, charters, and treaties in plain language.
  6. It shall be the duty of the Commonwealth to permit the creation of territories at the direction of the Senate, facilitated by the Executive.
  7. Should the Senate and Supreme Court adjourn sine die, all flags shall be grounded until the adjournment expires.
    1. Such an adjournment may expire at the direction of the President of the Commonwealth or the Supreme Court.

Article X

  1. The Executive branch shall collect data from citizens for the purposes of maintenance of a national database.
    1. Such data shall be collected as name, date of birth, gender, and other data.
    2. The data collected shall be shared within the government and her branches.
      1. Only the Executive branch shall collect data, and the Judicial and Legislative shall request data from the Executive.
    3. The powers granted to citizens shall be granted by the Executive, unless the Senate or Supreme Court object.
    4. Citizenship and suffrage are granted with this national database.
      1. Citizenship can be granted by a Supreme Court ruling, as well as by Senate resolution.
    5. Citizenship requirements may be set at the discretion of the executive branch.
      1. Any such requirement may be altered by the Supreme Court or Senate.
    6. Citizens are granted the free ability to access and control the data the Commonwealth may collect.
      1. Should a citizen request to delete any and all data collected, their database entry shall become null and void, their citizenship be voluntarily renounced.
  2. Should an outstanding debt be held, the ability to be forgotten, along with the right of renunciation of citizenship, are to be restricted unless the debt is repaid.

Ratification

I, as President of the Commonwealth of Acropolis, hereby certify the above signatures as Senators Pro Tempore, thereby finalizing the ratification of the Constitution of the Commonwealth of Acropolis, as written, into full force and effect, now and forever after this day

Pre-Ratification

  1. The duly deputized and appointed Recruiter-General, Dao Mokado, shall communicate with the President any individuals wishing to sign this Constitution.
  2. Due to the standing appointment of the Recruiter-General, the signature, present in the section above, shall not be treated as actual.
  3. Should the Recruiter-General find the number of signatures on this Constitution satisfactory, they may step down and notify the President of such.
  4. So long as the Recruiter-General is in power, Article VIII of this Constitution may be amended without reconsideration of Article VIII, provided only the formula and word tense are modified.
  5. This section shall be enforced by the Recruiter-General pursuant to their interpretation.
  6. This section shall expire upon the Recruiter-General stepping down.
